Justly Prudent Secures Major Victory in $200,000 Deposit Dispute with Prince George's County

VICTORY! Attorney Jordan D. Howlette secures win against Prince George's County in breach of contract case. Court orders return of client's $200K deposit, plus interest and attorney fees, after County failed to satisfy contract conditions yet refused refund.


On March 7, 2025, the Circuit Court for Prince George's County issued an Order in favor of our client, New County, LLC, finding that Prince George's County failed to fulfill a fundamental condition precedent under a Land Disposition and Development Agreement, yet wrongfully refused to return our client's security deposit that had been held in escrow since 2018.


At the heart of the dispute was the County's failure to declare certain property as surplus before selling it to our client for development. The Court agreed with our position that this constituted a material breach that entitled our client to a full refund pursuant to the plain language of the Purchase Agreement. Despite the County's admission that it failed to meet this condition, it had improperly refused to authorize the escrow agent to return the funds to New County, LLC.

"Our client rightfully expected the return of their deposit after the County failed to perform its obligations, and we are pleased the Court recognized this clear contractual right."


The Court's ruling not only orders the immediate release of the $200,000 deposit plus all accrued interest, but also awards our client reasonable costs and attorney fees pursuant to the terms of the Purchase Agreement.
